You make good and excellent points, but at the same time I still feel like 'it's fanwork if you say it is' is the standard I want to advocate for. For two reasons: One is that the AO3's overriding ethic seems to be to preference the wishes of authors, so their descriptions of their own work should be paramount. And the other is that using any other standard is going to be problematic on so many levels; who makes the judgment? Do legalities become involved? melannen's post points out some grey areas that make my head swim.

So...I don't know! But I'm glad you posted this.
